Using PrickleMind

These Terms of Use apply to the PrickleMind app and its supporting webpages (the “service”). PrickleMind lets you create vocabulary sets, practice with quizzes, and schedule Recall Sessions with reminders. By using PrickleMind, you agree to these terms. If you do not agree, do not use the service.

You must be at least 13 years old to use PrickleMind. If you are under 18, you need permission from a parent or legal guardian. Please review these terms together.

Our Privacy Policy explains how PrickleMind handles your information.

Your account

Provide accurate account information and keep it current. Protect your sign-in credentials and use only an account you are authorized to access. You are responsible for your use of the account and activity you authorize. Contact PrickleMind promptly if you suspect unauthorized access; never send your password to support.

Acceptable use

Use PrickleMind lawfully and respect others’ rights. Do not:

• Use the service for fraud, impersonation, harassment, or other unlawful activity, or add content that violates another person’s privacy or intellectual property rights.
• Access another user’s account or data without permission, bypass access controls, or interfere with the service’s security.
• Introduce malicious code, disrupt the service, or use automated requests to overload it.

Your vocabulary content

You retain ownership of the vocabulary set titles, descriptions, terms, definitions, and other content you create. You are responsible for its accuracy and for having the rights or permission needed to use it in PrickleMind.

You give PrickleMind only the limited, nonexclusive permission needed to store and process your content to provide the service to you, including displaying it in your library and using it in your quizzes and Recall Sessions. This permission does not transfer ownership or allow unrelated uses. Content retention and deletion are described in the Privacy Policy.

Image scanning

Image scanning is optional. When you choose to scan, the selected image is resized and compressed on your device, then transmitted through PrickleMind’s Firebase Cloud Function to OpenAI solely to extract vocabulary and provide this feature.

You must have the rights or permission needed to submit the image for processing. Do not submit unlawful material or content that violates another person’s privacy or intellectual-property rights. Avoid images containing personal or sensitive information.

AI results may be inaccurate. Review and correct the extracted terms and definitions before saving; only the terms you confirm with Save Terms are saved to your learning library. See the Privacy Policy for detailed processing information and its service-provider and retention disclosures.

PrickleMind’s intellectual property

PrickleMind retains its intellectual property rights in its original software, design, branding, and service content. Your content remains yours, and third-party materials remain subject to their owners’ rights. These terms permit you to use the service; they do not transfer PrickleMind’s intellectual property to you. Do not copy or distribute PrickleMind’s protected materials without permission, except as allowed by law.

Availability & access

PrickleMind may change, suspend, or discontinue features or the service. Availability and reminders can depend on your device, settings, connectivity, and service providers; uninterrupted access is not guaranteed.

PrickleMind may suspend or terminate access for material violations of these terms, misuse, security risks, or legal requirements. Where reasonably possible, we will give notice and an opportunity to resolve the issue; urgent security or legal reasons may require immediate action. You may stop using PrickleMind at any time. Contact support if you believe access was restricted in error.

Account deletion

You can permanently delete your account through Profile → Delete Account in the app or at Delete Account on the web after verifying account ownership and confirming deletion. Signing out or uninstalling the app does not delete your cloud account. See the deletion page and Privacy Policy for what is removed, retained security records, and device cleanup limits. If you cannot sign in, contact support for help.

Warranties & liability

To the extent permitted by law, PrickleMind is provided “as is” and “as available,” without express or implied warranties, including merchantability, fitness for a particular purpose, and noninfringement. PrickleMind does not guarantee error-free operation or any particular learning result.

To the extent permitted by law, PrickleMind is not liable for indirect, incidental, special, or consequential losses arising from use of, or inability to use, the service. These terms do not exclude or limit liability for fraud, willful misconduct, gross negligence, violations of law, or any liability that cannot legally be excluded or limited. Nothing here limits consumer rights or warranties that applicable law does not allow to be waived.

Governing law

California law governs these terms, without regard to its conflict-of-laws rules. This does not deprive you of mandatory consumer protections under the laws where you live.

Changes & contact

PrickleMind may update these terms by posting a revised version here and changing the effective date. Changes apply from that date, not retroactively. We will provide any additional notice or obtain consent required by law. Please review this page for the current terms.
